The District and Sessions Court of Islamabad on Monday issued a show-cause notice to the Chairman of the Capital Development Authority (CDA). It directed him to appear in person at the next hearing of a case about the implementation of a court decree issued in 2000.
The case is titled "Muhammad Rashid versus Chairman CDA" and was heard by Civil Judge Nasiruddin. According to the reports, the court had earlier issued arrest warrants for the CDA chairman in connection with the matter.
The petitioner obtained a decree in his favour in 2000. The case later reached the Supreme Court, which upheld the decision in favour of the petitioner.
Muhammad Rashid says he is among the people affected by the CDA's land acquisition. His position is that the authority acquired his land but has not given him the benefits available under its rehabilitation and resettlement policy.
The petitioner told the court that the decree had not been fully implemented despite the earlier judicial decisions. Barrister Hasnain Haider Thaheem appeared as his counsel and asked the court to ensure the decree is implemented effectively and completely.
After hearing the matter, the court issued the show-cause notice and ordered the chairman to appear in person at the next hearing. It also directed the relevant officials to ensure the decree is implemented and ordered that they face legal proceedings in connection with compliance.
The proceedings concern enforcement of the decree granted to Muhammad Rashid in 2000 and upheld by the Supreme Court. He is seeking the benefits he says are due under the CDA's rehabilitation and resettlement policy after the acquisition of his land.
Why it matters
